CONCLUSION AND TERMINATION OF THE SALE AGREEMENT
These Terms, as well as the individual terms of sale indicated with information about specific products, constitute an offer by Kameni nakit jdoo to conclude a Contract, and the user as a customer accepts the same by registering, concluding an order or in another way determined by these Terms, which is considered to have concluded a Contract between users and Kameni nakit jdoo, and according to the conditions of sale specified in these Terms.

On the occasion of the conclusion of the Agreement, the user will be provided with an electronic review and/or an email delivered to the email address containing: a confirmation of the concluded Agreement, i.e. a pre-contractual notice from Article 57, Paragraph 1 of the Consumer Protection Act (Official Gazette, 41/14) , these Terms, and the notice on the user's right to unilateral termination of the Agreement with the form for unilateral termination of the Agreement from Article 61, paragraphs 1 and 2 of the Act on Consumer Protection.
The user/customer can unilaterally terminate the Agreement within 14 (fourteen) days without giving a reason. According to Art. 79, paragraph 1 of the Consumer Protection Act (Official Gazette, 41/14), the user does not have the right to unilaterally terminate the Agreement if the service has been fully fulfilled, and the fulfillment has begun with his express prior consent and with his confirmation that he is aware of the fact that will lose the right to unilaterally terminate the Agreement if the service is fully fulfilled.
In order for the buyer to be able to exercise the right to unilaterally terminate the Agreement, he must notify Kameni nakit jdoo of his decision to unilaterally terminate the Agreement before the expiration of the term, by an unequivocal statement sent by mail (to Kameni nakit jdoo, Sarajevska cesta 68, 10000 Zagreb) or by e-mail to: [email protected], in which he will state his first and last name, address, phone number or e-mail address, order or invoice number, and he can also use the specified written form for unilateral termination of the Agreement. The deadline for unilateral termination of the Agreement is 14 (fourteen) days from the day when the goods that are the subject of the Agreement were handed over to the customer or a third party designated by the customer, who is not the carrier, or, in the case of a service, from the conclusion of the Agreement.
If the user unilaterally terminates the Agreement, he will be refunded the money received from him, including delivery costs, without delay, and at the latest within 14 (fourteen) days from the day when Kameni nakit jdoo u, i.e. Web Shop Kameni nakit receives the user's decision to unilaterally terminate the Agreement. At the time of ordering an individual product from the offer, the user/customer (in the sense of the Consumer Protection Act) by agreeing to the Terms of Purchase confirms that before concluding the contract he has taken note of the information published on the domain www.kameninakit.com and its sub-pages, i.e.: name, title , OIB and the trader's headquarters, the ways in which he can express his objections; information on the products that are offered, and their name, main features as well as the price of the product, information on the costs of product delivery; as well as information on the method of payment, and the method and term of delivery of the product.

REPLACEMENTS, COMPLAINTS AND OBJECTIONS, AND MATERIAL LIABILITY

The ordered products are packed in such a way that they cannot be damaged by normal handling during transport/delivery. In the case of a justified complaint, it is possible to terminate the contract with a refund of the amount paid or replacement of the product. If the delivered goods are damaged and/or defective, the customer can return the item to the previously mentioned address, so that the complaint is accepted based on physical evidence. If a careful inspection determines that the product has been damaged by a deliberate/accidental mechanical process, i.e. tearing of material, buttons, threads, zippers or other components of the product, which occurred after the product was inspected and sent to the customer, the claim will be rejected or dispute. In such a case, the buyer's material responsibility for the purchased product is determined.
Also, it is emphasized that according to Art. 43 of the Consumer Protection Act (Official Gazette 41/14), paragraphs 5 and 6, there is a right that, if a material defect in the product appears within six months from the date of transfer of risk to the customer (from the date of purchase of the product), and the trader believes that the defect did not exist at that time, the costs of the expert opinion are borne by the trader. If a material defect in the product appears after six months, but no later than 24 months from the date of transfer of risk to the buyer/consumer, the costs of the expert examination shall be borne by the consumer or the trader, depending on the result of the expert examination. The merchant is not responsible for material defects on the product that appear after two years from the purchase of the product.
